1. The Service
Duck & Key (“the Service”) is a homebuyer readiness tracking platform used by mortgage loan officers, real estate agents, and housing counselors (“Professionals”) to track their clients' (“Clients”) progress toward mortgage readiness using the S.A.I.L. framework — Score, Assets, Income, and Liabilities. Duck & Key is not a lender, mortgage broker, credit reporting agency, or consumer reporting agency, and does not originate, underwrite, or process loan applications.
2. Self-Reported Data — Not Financial Advice
All S.A.I.L. inputs — credit score estimates, savings amounts, income sources, and liabilities — are self-reported by the Client. Duck & Key does not verify, audit, or confirm the accuracy of any self-reported figure against a bank, credit bureau, employer, or any other source.
- This is not a credit pull, credit check, or soft/hard credit inquiry of any kind.
- This is not a loan application, pre-qualification, or pre-approval.
- This is not financial, legal, tax, or mortgage advice.
- Readiness percentages and grades are estimates for planning purposes only and are not a guarantee of loan approval or any specific loan terms.
3. User Accounts & Responsibilities
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate information when creating an account and to keep it up to date.
Professionals are responsible for the accuracy of any branding, licensing information, and content (including compliance disclosures) they add to their own account, and for how they communicate with their invited Clients.
4. Subscription & Billing
- New Professional accounts start with a 30-day free trial. No credit card is required to start a trial.
- Paid subscriptions are billed monthly or annually, at the rate shown at checkout, and renew automatically until canceled.
- You may cancel at any time from your Billing page; cancellation takes effect at the end of the current billing period, and you retain access until then.
- Fees already paid for the current billing period are non-refundable, except where required by law.
- We may change subscription pricing with advance notice; continued use after a price change takes effect constitutes acceptance of the new price.
5. Professional Compliance Responsibilities
Duck & Key provides tools — including a compliance content editor and audit log — to help Professionals document their communications. Providing these tools does not mean Duck & Key guarantees, monitors, or is responsible for any Professional's compliance with applicable law.
Professionals are solely responsible for ensuring their own use of the Service — including any content shown to Clients — complies with all applicable laws and regulations, including but not limited to the Mortgage Acts and Practices Rule (Regulation N), the Truth in Lending Act (Regulation Z), the Real Estate Settlement Procedures Act (RESPA), and any applicable state licensing requirements. Professionals should consult their own compliance counsel or designated compliance officer.
6. Data Privacy
Our collection and use of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference.
7. Disclaimers & Limitation of Liability
The Service is provided “as is” and “as available,” without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that any readiness estimate will match the outcome of an actual loan application.
To the fullest extent permitted by law, Duck & Key's total liability for any claim arising out of or relating to the Service is limited to the amount you paid us in the 12 months preceding the claim, and we are not liable for any indirect, incidental, or consequential damages.
8. Termination
You may stop using the Service and close your account at any time. We may suspend or terminate accounts that violate these Terms, misuse the Service, or fail to pay applicable fees.
9. Governing Law
These Terms are governed by the laws of the State of Tennessee, without regard to its conflict-of-laws principles, and any dispute arising from these Terms or the Service will be resolved in the state or federal courts located in Tennessee.
10. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we'll update the “Last updated” date above. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
